By accessing and using SomTMS ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Service Description

SomTMS provides a cloud-based Transportation Management System for carriers, including load management, dispatch, settlements, accounts receivable, and reporting features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

The Service is provided on a subscription basis. Payment is due monthly in advance. We reserve the right to modify pricing with 30 days notice. Failure to pay may result in service suspension or termination.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Upload malicious code or engage in any activity that could harm the Service
• Violate any applicable laws or regulations

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SomTMS and are protected by international copyright, trademark, and other intellectual property laws.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify or discontinue the Service with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, SomTMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
